1. GENERAL
The sale and delivery of goods and/or services to be carried out by will be subject to these General Conditions of Sale, unless explicitly agreed in writing by both parts.  Any amendments to these general conditions of sale shall only be binding if Air Magic has agreed them in writing.

Before an order is processed, at the check out form, you will be asked to tick a box confirming your agreement to proceed with your order in accordance with Air Magic’s Terms & Conditions Of Sale.

2. PRICES & TAX
Unless otherwise shown the price stated for the goods includes IVA on retail sales. The carriage is made at the checkout page and are clearly shown before you reach the point of submitting your order. The shipping/delivery charges are for SPAIN only and export-shipping charges are available upon application. For deliveries outside the European Union no VAT will be charged, however import duties may be payable on receipt of the goods. You will be liable for any import duties levied.

3. DESPATCH POLICY
We make every effort to ensure that all the items on our web site are available from stock, unless otherwise stated. We offer no absolute guarantee of availability and this electronic publication does not constitute an offer for sale. Upon receipt of your order we will contact you by telephone within a short time to advise you of the availability of the item you have ordered. If the item ordered is not available, we will let you know of any suitable alternative. Goods are normally despatched within 2 working days (or same day if express delivery ordered).

4. DELIVERY AND RISK
Air Magic has sole discretion in appointing the transport company. Where the goods ordered have been damaged in transit, the buyer must report this immediately to Air Magic and the transport company. A report outlining the nature of damage must then be put in writing within 48 hours days of receipt of goods, and must be sent by fax or e-mail to Air Magic. No complaint as to quality or quantity will be accepted after this date and it will be deemed that the goods have been received to the entire satisfaction of the buyer.

Air Magic shall not assume any responsibility, although the defects are clearly evident, if the goods have been handled or treated in whatsoever manner, or if the defects are due, as a whole or partly, to an incorrect storage or transport, to an incorrect, negligent or imprudent use of the products or to external causes such as damages caused by water or fire.

5. RETURNS POLICY
All goods are sold under our guarantee that they operate to the stated level in accordance with the manufacturers specifications. If within the period of twelve months following delivery the goods are found to be faulty you may return the goods to our warehouse (at your expense) and receive either repairs to the equipment or replacement goods (return to you will be at our expense). We may be contacted by telephone, fax, e-mail or post at our Head Office in Alhaurin El Grande.

If goods are returned for any reason other than fault, then subject to Air Magic accepting the goods, a 15% re- stocking charge will be levied.

6. CREDIT CARD SECURITY
We know of no documented cases of credit card fraud using our shopping system over the internet. All credit card numbers are encrypted in the software when the order is placed through our secure servers. They are only decrypted after they reach our computer.

We will only deliver to the cardholders billing address. Where an address different to the credit card holders billing address is used, you will be contacted by a member of our sales staff and asked to provide copies of utility bills and/or ID documents in order to prevent fraudulent use of credit cards. As a new customer we will only ship to a secondary address if a link with the address can be proved.

7. RIGHT TO REFUSE ORDER
We reserve the right to refuse to process an order due to suspected fraud or unauthorized or illegal activity. If such is the case, we may reject your order and refund the payment if any. We also reserve the right to refuse to process any order for any reason where no payment was processed. If you have notified us of a problem with the goods, we will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question. We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresen ation or for death or personal injury resulting from our negligence.

8. AIR CONDITIONING INSTALLATION
Where a customer has specified fitting within Air Magic's fitting areas, it shall be noted that the fitting costs have been calculated on a simple back to back installation basis.  Where scaffolding, pvc trunking, additional electrical services or any other services or items are required, then these shall be billed to the customer at Air Magic's current rates details of which are available upon request. 

9. INSTALLATION DATE
Where a customer has been notified of an installation date, any cancellation or amendment to the date agreed will have to be notified to Air Magic in writing, at lease 48hrs before the date confirmed.  Alternatively a fee of 100 euros will become payable by the customer.  If there is any delay on the part of the customer, making it difficult for the installation to be carried out promptly end efficiently, the customer will be billed at the rate of 50 euros per hour for any unreasonable delay.  Air Magic, shall be deemed to have the customer's authority to debit any additional monies automatically from the card holders account.

10. CONFIDENTIALITY
Customer details are not passed to third parties and are used only in accordance with the Data Protection Act.

11. LIABILITY
Whilst every effort is made to ensure that the information on this website is accurate we will not be not be held liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of inaccurate information.  All photos are used for illustration purposes only.

12. INDEMNITY
You agree to indemnify us against any claims, losses, liabilities, damages and expenses (including legal fees), arising out of your improper use of this web site.

13. JURISDICTION
Unless otherwise stated and agreed in writing by Air Magic, the contract will be governed by Spanish Law and the parties to the contract shall submit to the jurisdiction of the Spanish Courts.

14. CONSUMER RIGHTS
None of the above Terms & Conditions effects your statutory consumer rights.
